Archive Law is the foundation of the accountability and transparency of the government’s operation

Former Director, Government Records Service of Hong Kong Chu Fuk Keung stated that government can delete any records without under the protection of the Archives Law. And the citizens are hard to monitor the government operation.

Chu said, Hong Kong does not acquire the Archives Law and the Freedom of Information Act. However, Chu described, these are two major weapons of journalist to find out any problems or hidden facts in order to monitor the government. Without the protection of the Archive Act, government has no responsibilities to create, keep, manage and publish the record that are important to the public. He said, just like the ferry crash disaster in Lamma Island happened in 2012 that 38 people were killed, there was a file created but not saved and managed. He claimed that this is the way the government treat the records that harm their reputation. Thus, Chu strongly suggested that Hon Kong should establish the Archive Law and the Freedom of Information Act to ensure the accountability and transparency of the government operation.

However, Chu felt pessimistic about the approval of the Archive Law and the Freedom of Information. He said, the purpose of the law is to monitor and restraint the power of the government. The government has no benefits to establish this law. But he said, the Archive Action Group planned is planning to invite Yvonne Leung Lai-kwok, who is the president of the University of Hong Kong students' union, to apply the injection that prevents the government delete the records related to Occupy Central period. But he predicted that the application will be already forbidden in the initial stage.
