The head of Flagship Co. Ltd said that the Broadcasting Ordinance and the Medical Council Ordinance laid down years ago needs to be modified because of new media.


“Nowadays we have lots of social network platforms, like Facebook. The rule established decade ago may said can rule the advertise about medical, but can also say cannot rule them,” said Dixon Wu, the director of Flagship Co. Ltd, during an assembly at Hong Kong Shue Yan University.


According to the Generic Code of Practice - advertising standards, some drugs and medical methods, such as smoking cessation, treatment of diseases of the hair and scalp clinic and pregnancy test services, do not allow advertising on television and radio.


Wu added that some people using this uncertain to make profit. However, some just do not understand the law. “Many customers do not want to abide by the rules, but due to the unknown to the Ordinance, they do not know how to apply an old law to the new media. Thus, they strayed into the gray area, breaching the law,” said Wu.


“New advertising channel like apps and Facebook need to be clarified how to use by the Ordinance,” said Wu, believing the government should clarify and amend the law to suit nowadays society.


“It may not be bad that doctors cannot advertise in Hong Kong as long as they use Code of conduct,” said Wu.
