Public Consultation on the draft code of Copyright (Amendment) Bill 2011 is available now. The public worries that it will curb freedom of expression. “The public does not need to worry (x) it too much,” said Geordie Toh, the Legal Advisor of global technology company in a talk held by Hong Kong Shue Yan University.

If the Copyright (Amendment) Bill is passed, anyone who uses others’ products to reproduce an article may face criminal prosecution. Lampoonists and satirists are keen to recreate some pop songs, movie posters and movies to criticize the government. However, there will be limitation of creation and freedom of expression once the bill is passed. (good!)

Toh said that “copying is not theft” only if the motivation of copying is not for oneself(x) profit maximization. He takes the example of the previous chief executive candidate Henry Tong whose picture is designed in the poster of Harry Potter. “It is a good design to draw readers’ attention.

However, “If copying is for earning money, it should be regulated,"said Toh.

Toh does believe that lampoonists and satirists will not be prosecuted by the government (by-for) using the Copyright (Amendment) Bill.
