Copyright (Amendment) Ordinances cannot be too tight

Restrictions are needed in Copyright (Amendment) Ordinances 2011 but it cannot be too tight, said Geordie To, a legal consultant of an Internet company at Shue Yan University forum yesterday. [What does the new law actually state? Can you provide some kinf od summary?]

After the announcement of Copyright (Amendment) Ordinances 2011, many people worry that the freedom of speech on web would be restricted and think it is compressing people’s creativity. They name this amendment as the “Article 23 on the Internet”. [What is the normal Article 23? What does this reference mean?]

To described the situation as “unhealthy” if the ordinances are too strict. He said: “In the previous Chief Executive election, we can see many “second creations” on web. They are all very creative. If these creations are banned because of copyright matter, I would be very disappointed.”[What are second creations?]

However, with his expertise of being a legal consultant, he said it would not be very serious if people make “second creation” simply with names of politicians in order to mock them. But if people re-edit literature to gain profit, they may be found guilty. [What's the difference between the two? Isn;t using politicians' names a re-edit?]

Concerning government could be the prosecutor to charge those who invade copyright after the amendment, To said it will not affect the freedom of speech severely. “If the government didn’t work with the creations’ owner to prosecute, it is difficult for the government to estimate the loss after violation of copyright,” he said. [If he thinks it won;t affect freedom of speech severely. why is he concerned about it?]

To said: “I hope our government can strike a balance between creation and copyright in making the amendment and the legal process should be reasonable and valid.”
