Copyright law will suppress freedom

The introduction of Copyright (Amendment) Bill by government has attracted controversy recently. Geordie Toh, legal consultant of a network company, said suitable limitation was needed to relief the new Amendment.

“According to the second amendment of the copyright bill, the Government can sue the infringers without the approval of the creator, which is the direction of wrestling and reflected the balance of technology and media at same time,” Toh said. In addition, he worried that if completely open space of the second creation, the famous artist’s work will be stolen, the condition will be out of control.

Toh said that although he hasn’t read the detail of the Bill, he thought that the strict copyright law will kill the creative works. “Give an example, someone changed Harry Potter’s poster with Henry Tang’s photo in order to use an ironic way to show Tang’s illegal storeroom under his house. If the copyright law is too strict that stops people using any original products to modify, this will surely kill creativity among citizens,” Toh said, “I think, the government should maintain a balance between copyright and creativity.”

He continued to say that some people might use famous work from others such as Jin Yong, famous novel writers, wuxia to earn profits. Therefore, he said that suitable limitation on re-creation is needed to protect the rights of the original owner of the publications. However, he said that he couldn’t comment more on the topic before he has read the whole bill.
