Derivative works like Henry and the chamber of secrets should not be banned

With the recent amendment on the Copyright bill, people are concerned that the right of re-creation will be intervened. Geordie Toh, a counselor on online law, claimed that derivative works should not be banned.

Toh said, “Different derivative works are full of creativity and some of them are interesting, therefore creation on derivative works should not be strictly banned,” he continued and said the government should write the Ordinance in a concrete and precise way.

Among the derivative works, Toh likes the one Henry and the chamber of secrets most. It was a work to show the underground of Henry Tang, and the original character on the poster, Harry, was replaced by Henry.

However, not every kind of derivative work creation can be permitted. Some of those, which create bad emotions to the dead, should be banned.

Toh said, “Some derivative work used the photos of victims in history as a base of creation, such work should be banned as we should all show respect to the dead and their relatives,” he viewed such acts as a matter of ethics, not only copyright concern.

Toh claimed that those who wished to gain profits from derivative work should also be prohibited so as to show respect to intellectual property. He added, “For those simply for creativity and fun, should not be banned tightly.”
