Geordie Toh: Restriction Must be Given To Secondary Creation

Recently, the government has asked the <<Copyright (Amendment) Bill 2011>> to the Legislative Council and the revised draft has also brought controversy. Geordie Toh, the law consultant of a global technology corporation was invited to the general assembly of Journalism and Communication Department at Hong Kong Shue Yan University yesterday. He said the legal standards and means are the best ways to resolve copyright disputes. He said people who work on secondary creativity and innovation need not to worry too much on the amendment.


"Copyright law should protect the originality of production. The longer the protective duration, the greater the protection. This could give people who work on creativity a better guarantee of long-term remuneration. It also prevents others to trample the copyright of creativity, especially through the Internet," Geordie Toh said.


" There must be specific wordings on the Ordinance to restrict the secondary creations. If there's no limitation on the second creation, some of the primary creation might be abused for personal gain. This is unfair to primary creators. If the copyright is out of control, this is definitely not a good thing.," Toh said.


Although Toh agreed there should be limitations for the secondary creative works, those limitations shouldn't be too strict, otherwise secondary creativity would be compressed.
