Some people argued that secondary creations should be treated as a kind of trespass and urged the government to launch the Copyright Ordinance Draft (Amendment). However, Geordie Toh, a legal adviser of a network company, does not agree with those people, “Secondary creations are full of creativity,” he said when attending a seminar held by the Hong Kong Shue Yan University this afternoon.

"Secondary creation", also known as re-creation or derivative work, is the use of existing copyrighted materials of the texts, images, videos, music or other works of arts.

The launch of the Copyright Ordinance Draft is actually the criminalization of commercial-scale infringement. Toh agrees that there must be someone who infringed the copyright, however, he does think that secondary creations are full of creativity, "Some posters are really funny. I like the one that put the photo of Henry Tang (one of the candidate of the 2012 Chief Executive Election) on the Sphinx."

He added that the freedom of creation will be suppressed if the clauses are too strict and tight, "We should not support the ordinance as no one dares to produce these kinds of things to awake the care of people about social issues and political matters anymore."

Toh also said that despite the fact that some of the secondary creations may not be illegal; the creators should respect others' work and especially, respect the one they are mocking, "I've seen pictures that depicted politicians as pig and wolf. That is really a breach of etiquette."
