Strict copy-right law limits creativity

The proposed amendment of the articles 46 and 48 from the Copyright Law raised much attention, as the government is considering if re-creation should be published as a criminal law. Geordie Toh, the Legal Advisor of global technology company said: If the law is established, almost all creators will be criminals.


According to the draft published on the National Copyright Administration's website on March 31, the non-copyright holder has to comply with article 48, which states users must apply to the State Copyright Bureau, pay the owners via the Music Copyright Society of China and state the copyright owner.


“I will feel very disappointed if derivative works are all banned and becomes illegal,” said Geordie Toh.


He said since many web users recreate someone’s original work, as leisure or share in forums or blogs. The government shouldn’t see this kind of derivative work is violating the copyright law.


‘The law shouldn’t be too strict, otherwise it will limit people’s creativeness,’ said Geordie Toh.
