Objective Need For Charity Law

Lu Tak Ming, CEO of local charity Yan Oi Tong, said that there should be legislation of “Charity Law”, said in a student seminar.

Currently there ain’t specific law governs charities in Hong Kong, Lu said that there are some “charitable” organizations which have selling and fundraising for own profit, charity law helps regulating those informal organizations. He said that some charitable organizations are not applying licenses when they are organizing activities, like the entertainment licenses of Home Affairs Department, or permission related to social welfare department.

According to the Inland Revenue Department, there are more than 7500 institutions and trusts registered under section 88 of the Inland Revenue Ordinance.

Lu said that informal charities bring a larger impact to small charities, but to Yan Oi Tong, he said more than 80% of fund is subsidized by the government, those informal charities brings only little effects on them.

Lu said that the charity law is a sensitive issue to charitable organizations, but there is objective need and it can regulate out informal organizations. However Lu hopes that the law won’t be too strict, and there won’t be obstructions to the creativity of charities in organizing activities.
